PRIVACY POLICY

 
SIA "Izsoļu nams", reg. № 40103194965, the auction house "Artembassy" (hereinafter referred to as "the Auction House"), when processing personal data, undertakes to protect the privacy of personal data. To the data processing, the general regulation of data protection of the EU GDPR is applied, as well as the relevant government regulations. The current Privacy Policy describes general way of collecting, exchanging and protecting personal data.
Definitions:
The website (home page) of the Auction House - www.artembassy.lv
Customer - the user of the site, the buyer, the seller (an individual who uses or has expressed an intention to use the services of the Auction House).
Regulation - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Text with EEA relevance)
Controller - Auction house to which you provided your Personal Information.
Personal data - any information about an identified or identifiable individual.
Processing - any action with personal data (collection, saving, making changes, granting access, etc.)
Services - any kind of services provided by the Auction House online and / or at the actual address
This Privacy Policy applies to every customer whose personal data is processed by the Auction House.
 
1. How does the Auction House collects personal information?
By receiving information from the client, when completing the registration form on the site, the form “consign to a sale”, the form "ask a question", when making changes to the profile in "My profile" and at the conclusion of the contract, the act of acceptance-transfer.
2. What personal data do we collect?
2.1. Data of users of the website: name, surname, e-mail address, telephone number.
2.2. The data of the auction house participants (buyers): first name, surname, personal identification number (if applied), e-mail address, phone number, delivery address. bank account details, purchase and bidding history;
2.3. Details of the sellers of the Auction House: name, surname, personal identification number (if applied), identity document (serial number, date and place of issue, expiration date), e-mail address, telephone number, delivery address (if applied), bank account details.
 
3. For what purposes are personal data processed?
3.1. Data processing is performed to identify the client, to administer the relationship of the auction house with real and potential Clients, i.e. acceptance of lots for bidding through the conclusion of a contract and drawing up an act of acceptance and transfer, placing lots on the site, placing lots in the exhibition hall of the auction house, holding trades in accordance with current rules, accepting payments from buyers (if necessary, invoicing), handing out or delivery of lots to buyers, payment to sellers (if necessary, invoicing). If necessary, for the administration of the above processes, Auction house can use communication methods by phone or by email. Auction house is using email to inform users about the upcoming auction, to send a reminder about opening and closing of the auction, to send out preliminary bills and to inform users about important changes, only if the user agrees to receive notifications by e-mail.
3.2. In order to enforce the legitimate interests of the auction house, in case of voluntarily intractable disputes, personal data can be provided to courts and / or law enforcement, considering the basic rights and freedoms of the Client.
3.3. If there is a need to process personal data for other purposes, the permission of the individual customer for processing personal data will be requested in advance.
 
4. Access to storage and protection of personal data
4.1. Personal data, which is contained in contracts, are stored in closed rooms with limited access. Access to personal data is available only from the management of the auction house and authorized employees of the auction house.
4.2. The data required for accounting is kept by the accounting firm in accordance with the regulatory enactments of the Republic of Latvia and in accordance with the requirements of the GDPR based on a contract concluded with the auction house.
4.3. Access to personal data is available to the partners of the Auction House (such as software developers, representatives of the hosting service), employees of the Auction House, for whom data processing is necessary to perform direct work duties. In turn, partners and employees ensure the processing of personal data and compliance with protection requirements in accordance with regulatory enactments of the Republic of Latvia and the requirements of the GDPR;
4.4. The auction house protects the data of individuals by using the capabilities of modern technologies, including tools such as
4.4.1. Encryption of data (SSL)
4.4.2. FireWall
4.4.3. Software for the implementation of protection against intrusion
4.4.4. Other activities in accordance with the current technological capabilities to meet the challenges of implementing data protection.
4.5. Data will not be sent outside the EU or EEA unless there is a need for technical support to protect the data.
 
5. Disclosure of data
5.1. The auction house does not disclose to third parties the personal data of the Client or any information obtained as a result of the provision of services and during the term of the contract, except for:
5.1.1. The Client's explicit and unequivocal consent;
5.1.2. at the reasonable request of persons specified by external regulatory enactments in accordance with the procedure and in the amount specified in the external regulatory enactments;
5.1.3. Data may be disclosed at the request of a competent public official in accordance with regulatory enactments of the Republic of Latvia.
5.1.4. Partners of the Auction House in accordance with clause 4.2. and 4.3.
 
6. Data retention period
Personal data is stored during the term of the agreement or until a request to delete, the data from the user is received, but without violating the current regulatory enactments of the Republic of Latvia, which require that certain documents should be kept for a certain period, then personal data will be deleted.
 
7. Client Rights
7.1. Individuals have the right to check any data associated with them, request changes, delete (in accordance with clause 6), prohibit the use of personal data to carry out informative mailings by e-mail, prohibit the transfer of data to partners, and require compliance with other rights of the Client on processing and storage of personal data in accordance with regulatory enactments.
7.2. The client can apply for the implementation of his rights as follows:
7.2.1. in written form in person, by presenting a document proving his identity;
7.2.2. by email.
7.3. Upon receiving the Customer's request for the implementation of their rights, the Auction House verifies the identity of the Client evaluates the request and executes it in accordance with regulatory enactments. The auction house sends a reply to the Customer in registered letter by mail to the specified contact address, or by the specified e-mail.
7.4. The auction house ensures the fulfillment of the requirements for the processing and protection of personal data in accordance with regulatory enactments and, in the case of the Client's objections, undertakes expedient actions for their resolution.
 
8. Consent of the Client to the processing of personal data and the right of withdrawal.
8.1. The Customer agrees to the processing of personal data by means of confirmation in electronic or written form
8.2. The client has the right at any time to withdraw the consent given to the processing of personal data, and in this case the processing of personal data that occurred on the basis of this consent before, will not be performed in the future.
8.3. The withdrawal of consent does not affect the processing of data that was executed at the time when the Customer's consent was in force.
8.4. By reviewing consent, processing of personal data that is made on other legal grounds cannot be stopped.
 
9. Communication with the Customer and receipt of notices
9.1. The auction house communicates with the customers using the contact details indicated by the Customer (phone number, e-mail address, postal address).
9.2. The Customer provides consent to receive notifications on the Home page in the registration form, or in the "My profile" section. The consent given by the Customer remains in force until its withdrawal (also after the expiry of the contract).
9.3. The client has the opportunity at any time to refuse to continue receiving notifications in one of the following ways:
9.3.1. To remove the check mark in the "My profile" section
9.3.2. To notify the Auction House by e-mail
9.3.3. To deliver the notice in written form to the actual address of the auction house, presenting an identity document
9.3.4. Send the notice in written form in registered letter by mail to the legal address of the Auction House.
 
10. Processing Cookies
10.1. We use the processing of cookies on the home page of the Auction House. The rules for processing cookies are posted on the Home page in the "Information" / "Cookies Policy" section.
10.2. On the home page of the Auction House, links to third-party home pages that have their own usage rules and personal data protection policies can be placed, but the Auction House is not responsible for their content, compliance and execution.
 
11. Other conditions
The auction house reserves the right to make changes and additions to the Privacy Policy, providing an opportunity to review and agree to their current version in the user profile, also placing them on the home page of the Auction House.
